Can you have two front yards? (yes!)

The July 21 Zoning Board of Appeals Agenda consisted of 1 public hearing and 2 projects for discussion.

1) Public Hearing - a property on Carroll Drive of .36 acres requested to setback variances - 1 for 20 feet to install an inground pool and 1 for 3.8 feet on a side yard for a shed. In addition the applicant would like a variance to enable 3 existing sheds to remain on the property where 2 are allowed.

The Variances were granted, with the condition that if any of the sheds are damaged or are replaced, any new structures need to conform to the zoning code.


Discussions

1) Wappingers Fresh Market. The applicant is proposing to purchase the Rite Aid building on the corner of New Hackensack Road and Route 9. The current building does not conform to set-back requirements (interestingly -- the village code requires less setback and this property is next to properties governed by the village). The variance would be for 58 feet - because the buidling is 19 feet from County Road 105, where 75 feet is required.

A Public Hearing was set for August 25.

2) A property on Paulette Lane -- has the distinction of also being on Robinson Lane -- thus... yea! has two front yards. Why does this matter, because set back rules are different for front yards vs. side yards and back yards. The applicant is selling the property and needs a variance so that a CO can be issued. The application would like to "legalize" a 12' x18' shed on the 1.26 acre property and requires setback variances to legalize the shed. The public hearing is scheduled for August 25th.
