A ZBA that confuses their personal opinions with their ZBA role
The September 8 ZBA agenda had three public hearings and a new project as a discussion. The public hearings, often open and closed with no public comment or input -- is a vehicle that neighbors or others with an opinion can speak to the board before a decision is made about a requested variance. The Chair often introduces the project by saying "I like what I saw when we visited" or some version of "I don't like it" -- and asks for opinions from the board members BEFORE hea

Oops -- Measure twice, dig once?
The August 25 ZBA Agenda consisted of 2 public hearings -- and discussion of three new requests for variances. The first request for a new variance came from Mid-Hudson Development - who is building a new home at 356 Old Hopewell Road. Apparently the foundation is 63.2 feet from Old Hopewell Road, were 75 feet are required. A "self-effacing" attorney representing Mid-Hudson Development apologized for the "mistake", but would like the board to consider a variance of 11.8 fe

When is it a Pool Repair vs. a New Pool
The June 23rd ZBA meeting in the Town of Wappinger veered off into Code Enforcement discussions. A property owner on Brothers Road came to the board requesting a large set-back variance to legalize an above ground pool on his property. The property has a drainage ditch on it, which, while the home owner purports to have a deed indicating that the ditch is a town easement, has subsequently been told that the ditch is not the town's responsibility, but it is his responsibility

Deck & Pool -- near storm water ditch
Public Hearing - To replace an old Deck on a property on DeGarmo Hills Road. The property has a road next to it, which provides a buffer between neighbors. The variance was approved by the board. Discussion - Brothers Road - .74 acre - Property has a town storm water ditch.. (not deeded to the town, the town is not going to maintain, but the water needs to continue to flow, an old deed does mention the town, but the town cannot verify that in their records), septic syste

Front Yard Fence on Route 9D?
The March 24 Zoning Board meeting had one item on the agenda - a public hearing for an applicant who would like to install a 6 foot fence in front of his property on Route 9D, where the code allows for a 4 foot fence. The applicant would like the fence to help protect his children - one who is on the spectrum and is bothered by loud noises and also does not understand danger and needs additional protections. The board, stated that they typically don't want to see 6 foot fen

The December 9 Zoning Board Meeting had a short agenda - Adjourned Public Hearing - The applicant on Dana Place - is requesting a variance 16' 9" where 20 feet is required (so they can only provide a 3'1") of to build a 25'x26' garage . Legal definitions, amendments sorted -- 33 Middlebush Road now can accommodate personal vehicles
With only two items on the November 12 ZBA agenda, the ZBA opened the Public Hearing for two items related to the building at 33 Middlebush Road. If you recall, the owners had obtained site plan approval for "contractor storage" but wanted to enable, for a potential buyer, the ability of that buyer to store personal vehicles that were not related to the contractor business. Several meetings, months have passed and wrangling about whether the code would allow such use hav

ZBA - Hudson Valley Volkswagen updates, garages and a rebuilt house
The October 28 Agenda of the Zoning Board included re-opening the Adjourned Public Hearing for Hudson Valley Volkswagen's request for a variance increase the size of the parking area beyond the code's limitations... thus reducing the code's requirement to have 25% open space. So while the 2% variance seem minimal -- it will allow for 33 additional cars to be parked (valet parking). These variances are required as a pre-req for the site plan ammendment requests which are bef

Hudson Valley Volkswagen's request plus shed, garages and a new house
The October 14th Zoning Board meeting consisted of two public hearings and the discussions for three new applicants. Public Hearings: Approved a request for an area variance on Relyea Terrace to allow the legalization of an exisitng 10'x15' shed Hudson Valley Volkswagen -- this is very confusing. The ZBA in the last meeting went back to the planning board to ask what the planning board thought about the requested area variances to allow 2% less landsacaping and 2% more park
