Oops -- Measure twice, dig once?
The August 25 ZBA Agenda consisted of 2 public hearings -- and discussion of three new requests for variances. The first request for a new variance came from Mid-Hudson Development - who is building a new home at 356 Old Hopewell Road. Apparently the foundation is 63.2 feet from Old Hopewell Road, were 75 feet are required. A "self-effacing" attorney representing Mid-Hudson Development apologized for the "mistake", but would like the board to consider a variance of 11.8 feet - claiming that the request is not radically inconsistent with other homes on Old Hopewell Road, and would really appreciate the board considering granting a variance. A site visit was scheduled for September 5, with a public hearing for September 8. Sure hope the measuring tape gets put to good use for the rest of the building.
The two public hearings --
Wappingers Fresh Market - the applicant, who has purchased the building (the former Rite Aid at 1604 Route 9, requires a set-back variance from County Road 105 (New Hackensack) for the current building. The Variance was granted -- and now the applicant needs to continue working with the Planning Board on the other site plan details.
A property on 40 Paulette Lane... which requires a set-back variance for a shed because the property backs onto Robinson Lane.. thus giving it two "front yards" -- was granted a variance for a shed that the board determined "no one can see" - when they did their site visit. The world is now safer.
In addition to the ill-placed foundation on Old Hopewell Road, the board reviewed a request from an applicant on Scotse Road, who would like a set back variance to accomodate stairs for a new deck. Also a fabric covered shed will also need to have a permit. Public Hearing September 8.
A shed on Pye Lane will need a 1.3 foot variance to the rear yard and a 2.3 foot variance to a side yard on a property of .44 acre - which has a "difficult" topology. the Public Hearing is scheduled for September 8.
