Set-back, Fence and Shed

The June 10 Zoning Board of Appeals meeting had three public hearings scheduled.
The First - concerned a property on Spook Hill Road where there is a difference of opinion between the applicant, represented by an attorney, and the building department on the measurements of a front porch that was built. The attorney argueing that the buiding inspectors had been at the site on several occasions to review the project as it was being built, as well as the members of the ZBA visited the site prior to the variance being granted -- and no one noticed that the point that the measurements were taken from was in dispute. The head of the building department for the town declared that it was not the responsiblity of the town's building inspectors to check on measurements, and the ZBA members said that they were trusting the line that was painted on the ground. And around and around the conversation went, with other issues being brought up - and the attorney saying that he would address those with his client. A member of the public spoke and cited issues with the property and the use of the property. The public hearing was closed, but the matter was adjourned until the July 22nd meeting (only 1 meeting in July). The ZBA attorney and the client's attorney will be working together to draft a list of conditions for the variance to be granted. The members of the ZBA will also review.
The Second public hearing on the agenda- at 127 Chelsea Road, a request for an 8 foot fence "agricultural" style to protect fruit trees on the property. No member of the public spoke, but the board is concerned about the look in the front yard of a high fence. The matter was adjourned until June 24th so that the client can present drawings to the board showing how the fence could look more "residential".
The Third public hearing on the agenda -An applicant on Myers Corners Road asked for a 40 foot variance to the rear yard line and a 15 foot variance for the side yard line - to place a shed. The property with the slope and property shape limits the area available for a shed. The variance was granted.
Two items for discussion on the agenda - a request for an area variance on Brothers Road, the applicant did not show. The appeal for 33 Middlebush Road for a use variance was rescheduled and the applicant has hired an attorney.
