ZBA reconfirms their decision on Gasland and prepares to send it to the court

The November 14 ZBA meeting included 4 public hearings and one project for discussion.

The Board approved all the variance requests where public hearings were held:

A variance for a larger garage than the code allows on Widmer Road.

A variance to legalize a barn that is bigger than the code allows on DeGarmo Hills Rd

A variance to renovate and extend a building that is under the minimum dwelling unit size on Stonykill Road.

A variance for setback requirements to extend front stelps at VornDran Drive.


The project presented for discussion is the legalization of an existing car port and a shed on Card Road. The ZBA members will visit on the 25th of November and a public hearing will be on the November 28th agenda.


The Board then attended to housekeeping - voting on a meeting scheduled for 2024 and postponing the discussion on Alpine Common to December 12.


The Board then read their response to the Court's request that they review two aspects of the Gasland project in Hughsonville. After a long recitation of the legal history of the project -- the board decided that their definition for "convenience stores" was fine and that their view of an "accessory structure" was fine and they stand by their original decisions. There was no discussion. Their decision has been filed with the Town Clerk and will be sent to the Court by the end of the month. We now await the court's review.
